Terms of Service

These Terms of Service (“Terms”) govern your use of cardly.funand the Cardly application (the “Service”), operated by Cardly (“we,” “us”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to create an account and subscribe to Cardly. By using the Service, you confirm that you meet this requirement.

2. The Service

Cardly lets you upload a photo and generates a short, personalized message and a shareable card built from it, for occasions like birthdays, holidays, and everyday moments. Generated messages are produced automatically and may not always be perfect — review a message before sending it to make sure it says what you want it to say.

3. Subscription & Billing

• Cardly is a paid subscription service, currently $5/month.
• There is no free trial — your subscription and billing begin as soon as you subscribe.
• Subscriptions renew automatically each month until cancelled.
• You can cancel anytime from the billing portal in your profile; you'll keep access until the end of the period you already paid for.
• Payments are processed securely by Stripe. Except where required by law, payments are non-refundable.
• We may change our pricing going forward; we'll give you notice before any change affects your existing subscription.

4. Your Content & Acceptable Use

By uploading a photo, you confirm that:

• You own the photo or have the right to use it, and, where the photo shows another identifiable person, you have their permission to use it this way
• The photo does not depict minors in an inappropriate context, sexual content, or violence

You agree not to use Cardly to:

• Upload content that is illegal, harassing, or infringes someone else's rights
• Attempt to abuse, overload, or reverse-engineer the Service
• Use the Service to generate content for someone without their consent, where that content depicts them

We may automatically decline to process photos that appear to violate these rules, and may suspend or terminate accounts that misuse the Service.

5. Intellectual Property

You keep ownership of the photos you upload. The message text and card generated for you are yours to use and share. Cardly and its branding, design, and underlying technology remain our property.

6. Disclaimers

The Service is provided “as is.” Generated messages are created automatically and we don't guarantee they'll be error-free, appropriate for every situation, or available without interruption. You're responsible for reviewing content before sharing it.

7. Limitation of Liability

To the fullest extent permitted by law, Cardly is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose.

8. Termination

You can stop using Cardly and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the date at the top of this page. Continuing to use Cardly after a change means you accept the updated Terms.

10. Governing Law

Cardly is operated by an independent entrepreneur, with formal company registration currently in progress. The governing law and jurisdiction for these Terms will be specified here once registration is finalized.
